OBBA is officially a law, reshaping the landscape for inspectors and investors.
The One Big Beautiful Bill Act (OBBBA) became law in 2025, reshaping tax rules that directly influence how property owners, investors, and developers plan their projects. At more than 800 pages, the details are complex for non-tax-savvy individuals.
From an inspection perspective, three key changes stand out. The law provides:
- Urgency for energy-efficient improvements due to expiring tax incentive deadlines (i.e., EV charging stations, solar and wind installations, and refueling system installations for greener fuels).
- Significant and permanent upfront tax deductions for qualifying capital improvements such as tenant improvements, major renovations, and system upgrades.
- Permanent redevelopment incentives in qualifying distressed and rural areas.
For commercial property inspectors, this raises the value of your work at every stage, from pre-acquisition assessments to ongoing ownership and capital planning. Here are three key considerations:
- Understand your client’s due diligence requirements and risk tolerance. Tailoring the scope accordingly ensures you’re delivering exactly what supports their decision-making and investment strategies.
- Highlight the financial value of your services and reporting. Comprehensive inspections and condition assessments of current conditions should not be commissioned solely as part of a due diligence requirement. An inspector’s findings and insights can deliver measurable
- ROI far beyond the inspection fee. Value-add services can be strategic choices for clients investing, managing, or owning CRE. Opinions of costs to remedy, cost tables, and reserve forecasts will increasingly prove to deliver measurable ROI far beyond the inspection fee.
Property owners and investors will continue to rely on commercial property inspectors not just for risk management through understanding property conditions, but also for maximizing tax strategies with their accountants.
